WHO IS THIS MADE FOR?
ARE YOU ASKING IF YOU SHOULD FILE BANKRUPTCY OR KEEP JUGGLING EVERYTHING ALONE?
When you are struggling with debt, many people delay filing for bankruptcy as long as possible; however, delaying may be more harmful than many realize. “People misunderstand bankruptcy and wait too long to see a bankruptcy lawyer. Most people would benefit by going earlier,” Professor Robert Lawless told CBS in a new article about the timing of personal bankruptcy filings. Robert Lawless, Professor at the University of Illinois College of Law, Personal bankruptcies are on the rise. When does it make sense to file? By Kate Gibson, Updated on: November 20, 2024

TOP 2 MYTHS ABOUT BANKRUPTCY
MYTH #1
After Bankruptcy, I Will Have No Credit for 7 to 10 Years
There is no truth to this legend that you have to go for seven or ten years with bad credit after filing bankruptcy. Bankruptcy will be on your credit report for 10 years, but many creditors know that you now have your fresh start and will consider you when they would not have done so before you filed. Our clients work hard to rebuild their credit in the first few years after bankruptcy and many receive credit card offers in the first months after filing bankruptcy. Our clients often purchase cars and qualify for mortgages within two to three years after their bankruptcy is over.
MYTH #2
People who file for bankruptcy did not manage money well.
Loss of some or all income into the home, divorce, and medical problems, along with low paying jobs that too many Americans have to take, cause nearly all bankruptcies. Financially struggling families use credit cards to pay for emergencies and to live day-to-day because they have no ability to save with the prices of basic necessities. Bankruptcy is often the very best way out to re-start their lives.
OUR SERVICES
Medical Bills Relief
Get Out From Under Crushing Medical Bills

An illness or accident can result in huge, unmanageable debts. If you have unpaid medical bills, you are not alone. Two thirds of all bankruptcy filings in the U.S. are due in part to medical reasons — and of those, three-fourths of those people had insurance! There is a solution for people who have crushing medical bills. Bankruptcy can enable you to completely eliminate or substantially reduce your unpaid medical debts.
A Chapter 7 bankruptcy can completely eliminate many types of unsecured debts, such as medical bills, credit card bills and personal loans. You can generally keep all of your property.
You Can Still Obtain Medical Care After Filing Bankruptcy On Those Medical Debts
Your ability to obtain medical care will not be affected if you file for bankruptcy. You will still be able to get the treatment you need.
Do Not Delay
Many people hold off seeking help from a bankruptcy lawyer for various reasons. The bottom line is this — by delaying you are only increasing your debts and coping with unnecessary stress and harassment.
Avoiding Foreclosure
Foreclosure is every homeowner’s nightmare. But it doesn’t have to happen to you. Bankruptcy stops foreclosure — and can lift the burden of debt.
If you are behind on your mortgage payments, or you are not paying other bills in order to stay current on your mortgage, the warning signs are clear. You need to act before you get in deeper financial trouble. We use the bankruptcy laws to stop foreclosure and get the financial breathing room they need to make a fresh start.
A Chapter 13 bankruptcy stops foreclosure. You will get an affordable payment plan that can enable you to regain your financial health. You can even roll your past-due mortgage payments into your payment plan.
A Chapter 7 bankruptcy also stops foreclosure for a while — long enough for you to find the money to get current on your mortgage or to find another place to live.
Credit After Bankruptcy
Your FICO Score often determines whether creditors will lend you money, how much, and at what interest rate. The higher the score, the better. As your debt-to-income ratio increases, your score decreases. Every late payment decreases your credit score. If you default on your loans without filing bankruptcy, your credit is likely to be so damaged that you will not be able to repair it by yourself. After we file bankruptcy for you, your debts will no longer burden you. You can get the extra cash flow you need to avoid late fees so you can rebuild your credit. Within a few short months, our clients start to see offers for credit cards, car loans are available again, and after a while, you can take out a mortgage.
Some people resist considering bankruptcy because they believe it will ruin their credit. In fact, the opposite is true. Most people’s credit scores start to improve right away, as your debt-to-income ratio is now zero. If you have had your wages garnished and/or are facing foreclosure on your home, or are risking the repossession of your car, filing for bankruptcy may actually improve your credit.
Wage GarnishmenT OR Creditor Harassment
Creative Solutions To Your Financial Problems

A creditor can obtain a court order and then garnish your wages or seize your bank account. You then have even less control over your life than you did before. Wage garnishment makes it impossible to make ends meet — threatening even your ability to pay the rent or mortgage. By filing bankruptcy, wage garnishment actions stop, as do the threat of lawsuit judgments, and creditor harassment.
Regain Control of Your Life
We Can Stop Creditor Harassment Immediately
As soon as you hire us to represent you, creditor harassment must stop. Bill collectors and collection agencies can no longer call you.
If they do, just say the magic words — ” Call my attorney “.
Inform them that our law firm is representing you and give them our phone number. We will handle all contact with that creditor from that minute on. You can focus on your real life, secure in the knowledge that an experienced lawyer is working hard to obtain relief for you.
Student Loan Relief
Under a Chapter 13 bankruptcy, it is possible to substantially reduce your monthly student loan payments without penalties. Think of what an extra two or three hundred dollars every month can mean for you.
Are your loan payments taking every extra dollar you earn?
Are your balances growing faster than you can repay your loans?

You can get the financial breathing room and extra cash flow you need. In many cases, BUT NOT ALL, student loan debts are not dischargeable in bankruptcy. If you are not eligible to fight to have your student loans discharged in bankruptcy, which we will advise you about after evaluating your situation and the current state of the law, our firm can still help you deal with the negative effects that your loans are having on your life.
Car Loan Relief
Hearing the word “debt”, most people think of credit cards. However, Americans collectively owe more on car loans than all of the credit cards combined, with the average car loan costing over $500 a month. This can be a huge burden, especially when you are struggling to make ends meet. Bankruptcy law allows you to keep your car while getting rid of your other debts. Sometimes bankruptcy can lead to a lower monthly payment, lower interest rate, and/or a lower payoff amount. In the end, bankruptcy can save you money on one of your most important possessions — your car – while protecting you from the lender.

Chapter 7 Vs. Chapter 13 Bankruptcy
Which Bankruptcy Option Is Best For You?
Filing for bankruptcy can reduce or eliminate many of your unsecured debts. It will stop lawsuits, foreclosure, wage garnishment, and vehicle repossession. It can give you the opportunity to make a fresh financial start. We use the bankruptcy laws to maximize the relief our clients receive, while enabling them to keep their property and financial assets.

Chapter 7 bankruptcy can almost completely eliminate unsecured debts such as credit card debts, medical debts, and personal loans.
Chapter 13 bankruptcy is ideal for people with a steady higher income who have assets they want to keep that are normally not protected in a Chapter 7. Chapter 13 stops foreclosure and can allow you to keep your house, sometimes eliminating second mortgages. Your debts are reduced or eliminated, and you develop an affordable payment plan through the court for your remaining debts.
